By accessing and remaining on the Website, the user accepts these general terms and conditions of contract. The User acknowledges that use of the Website is governed by the general terms and conditions of contract in force from time to time at the moment of the last access. These conditions are available in Italian and English. In the event of any discrepancy between the two versions, the Italian version shall prevail.
Before proceeding with any operation through the Website, the User is required to read the general terms and conditions of contract and to print a copy and store a copy thereof on a durable medium that allows the User to retain the information personally addressed to them so as to be able to access it in the future for a period of time adequate to the purposes for which it is intended and that allows the identical reproduction of the stored information.
The terms and expressions listed below shall have the meanings indicated below, it being understood that terms defined in the singular shall also be deemed defined in the plural and vice versa.
User: means any natural person acting on the Website for purposes unrelated to any entrepreneurial, commercial, artisanal or professional activity possibly carried out, aged 18 years or over.
Parties: means jointly the Real Estate Company and the Users.
Restricted Area: means that part of the Website made available for the exclusive use of the User, through which, upon authentication, the User may access specific functions.
Website: means the website www.houseofminerva.it of Savills Residential Italy s.r.l.
The contents of the Website are for purely informational purposes. Although the utmost care is taken in maintaining the Website and in selecting its contents, the Real Estate Company assumes no responsibility for the accuracy, completeness and timeliness of the data and information contained therein or on sites linked thereto; consequently, any liability for errors or omissions deriving directly or indirectly from the use of data and information present on the Website is excluded. The User is therefore required to personally verify the accuracy of the information contained on the Website before taking any action.
The user is invited to enter personal contact details in a registration form, supplementing them with any textual message that better clarifies their request. In any case, the User is required to provide personal contact details attributable exclusively to themselves and not shared with third parties.
The Website provides the User with the possibility to reserve an apartment for 24 hours, during which time it will not be visible or available on the Website (hereinafter, the “Reservation”). In the event that the purchase proposal is not finalized within 24 hours, the reserved apartment will become visible and available again on the Website. It will be possible to reserve only one apartment and only once.
For the purposes of the Reservation, the User will be required to enter a credit card number and it will be verified that the amount indicated on the Website is available on such card. Only at that moment will it be possible to reserve the apartment.
Following the Reservation, the indicated amount will be blocked and, consequently, for 24 hours it will not be available on the credit card. At the end of the 24-hour Reservation period, both in the event of failure to finalize the purchase proposal and in the event of finalization thereof, the blocked amount will become available again according to the contractual timelines defined by the User’s bank. In both cases, no charge will be made.
The Website provides the possibility for the User to submit a purchase proposal using, alternatively:
– editable drafts provided directly by the Real Estate Company. The User may access a text editing area, modify the proposed text and send their unilateral proposal directly to the Real Estate Company, through the systems made available from time to time by the Website.
– a customized proposal formation process, under the guidance of an operator of the Real Estate Company, who will take care to set out the User’s wishes in a contractual text.
The User shall be responsible for all activities and operations carried out with the activated Account and shall immediately notify the Real Estate Company, by email, of any unauthorized use of their account and access to the Restricted Area.
The Website, considered as a whole, as well as all the material contained therein, is protected by copyright laws and other intellectual property rights.
The contents published or otherwise present on the Website – including, by way of example and not limitation, trademarks, logos, images, communications and documents produced therein, as well as application software and the codes used for the implementation of the Website – are the exclusive property of the Real Estate Company, or are used with the authorization or license of the respective owner.
The Real Estate Company reserves all rights therein, including the right of reproduction: the User may use such contents only insofar as this is strictly necessary for the proper use of the Website. Any different use shall be considered prohibited. The copying and reproduction of any text present on the Website and/or present on other websites managed by the Real Estate Company is not considered a permitted operation.
The security of data transmitted via Internet network protocols cannot be guaranteed with absolute certainty. It is possible that third parties may intercept transmissions or private communications transmitted on the Website without the permission or knowledge of the Real Estate Company, which undertakes to adopt appropriate security measures, without ensuring the security of every piece of information transmitted or the security of access to the Website itself.
The Real Estate Company reserves, at its sole discretion, the right to interrupt or suspend the Service at any time in order to maintain, modify and/or update the Website. During the activities indicated herein, the Website may be temporarily unavailable or otherwise unusable.
Hypertext links present on the Website may direct the user to web pages on websites different from the present one, deemed to be of possible interest to the user.
The User acknowledges and agrees that the Real Estate Company has no control over the content of such sites and, as a mere third party, bears no responsibility for the content and/or material, including advertising material, disseminated on such sites or external resources.
These terms and conditions of use are governed by Italian law.
